However, there is no presumption that a person was or was not under the influence of alcohol or driving while impaired. Where an individual's blood or breath alcohol concentration is at least .07 but less than .08, the person is considered to bedriving while impaired. A blood or breath alcohol concentration of .08 or more is considered to be driving under the influence of alcohol.
